Terms of Service + Privacy Policy

You must comply with all applicable laws to use the Service. You represent that you are permitted to use the Service under the laws of your jurisdiction.

• Minimum Age: You must be at least 13 years old to use the Service (or older if required by your local law).
• Under 18: If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian.
• No Knowing Collection Under 13: The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we collected information from a child under 13, we may delete it and terminate the account.
• Parent/Guardian Responsibility: Parents/guardians are solely responsible for monitoring and supervising a minor’s use of the Service and for any consequences.

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity on your account, whether authorized or not.
• We are not responsible for account compromise due to weak passwords, reuse of passwords, phishing, or user negligence.
• You must notify us immediately if you suspect unauthorized access.

The Service may allow you to post content (“User Content”) such as text, images, links, media, and messages. You are solely responsible for your User Content.

• You represent you own or have the rights to post your User Content and it does not violate any law or third-party rights.
• We do not pre-screen all User Content and do not guarantee it is accurate, safe, or appropriate.
• We may remove or restrict any content at any time for any reason, with or without notice.
• By posting User Content, you grant MusicKraze a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your User Content solely for operating and improving the Service (including backups and moderation).

MusicKraze respects intellectual property rights. If you believe content infringes your copyright, submit a notice including: identification of the copyrighted work, identification of the material claimed to be infringing, your contact information, a good-faith statement, and a statement under penalty of perjury that the information is accurate and that you are authorized to act.

We may remove content and terminate repeat infringers. If you submit false notices, you may be liable for damages.

Moderation actions are discretionary and may be taken to protect the community and the Service. We do not guarantee we will catch or remove all prohibited content.

• No Staff Liability: Staff/moderators are not liable for moderation decisions or user disputes.
• No Duty to Monitor: We may monitor, but we are not obligated to monitor all content or behavior.
• Law Enforcement: We may report suspected illegal activity and provide information as required by law.

• We may change, suspend, or discontinue any part of the Service at any time without notice.
• We may suspend or terminate your account at any time for any reason, with or without notice.
• We have no liability to you for any modification, suspension, or discontinuation.

PLEASE READ CAREFULLY. This section affects your legal rights.

You and MusicKraze (including James Brady) agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may: (a) bring an individual claim in small claims court if eligible, or (b) seek injunctive relief for intellectual property misuse.

No Class Actions: You agree disputes must be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

The arbitration will be conducted in English and governed by the Federal Arbitration Act (if applicable). The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary. If any part of this section is found unenforceable, the remainder will still apply.

• Account Information: username, email address, and other information you choose to add to your profile.
• User Content: chat messages, profile text, images, media links, and other content you submit.
• Technical Data: IP address, device and browser type, referring pages, timestamps, cookies, and similar diagnostic data.
• Support/Contact Data: information you provide when contacting us for support or reporting issues.

• Provide and operate the Service (accounts, chat, features, moderation).
• Maintain safety, prevent abuse, enforce rules, and investigate violations.
• Improve performance, troubleshoot bugs, and protect against attacks/spam.
• Communicate with you about updates, security, or service-related notices.

We do not sell your personal information. We may share information in the following situations:

• Service Providers: hosting, security, analytics, email delivery, or other vendors who help us operate the Service.
• Legal and Safety: if required by law, subpoena, court order, or to protect the rights, safety, and security of users, the Service, James Brady, or the public.
• Business Changes: if the Service is involved in a merger, acquisition, asset sale, or similar event, information may be transferred as part of that transaction.
• Public Areas: anything you post publicly (chat messages, public profiles, public posts) may be visible to other users and/or the public depending on settings.

• Account Info: You can update certain profile information from your account settings (if available).
• Cookies: You can manage cookies via your browser settings.
• Communications: You may opt out of non-essential communications where applicable.
